Before beginning this or any exercise or massage program, it is highly recommended that you consult a physician. Individuals under the age of eighteen (18) must have a parent or guardian co-sign this Disclaimer and Liability Release.

VOLUNTARY PARTICIPATION

I, the undersigned, acknowledge that my participation in any program associated with GuruToYou, LLC, including yoga classes, pilates classes, strength training classes, massages, exercise or yoga workshops, nutritional classes, off-site events, or instructional programs (referred to in this Disclaimer and Liability Release as “fitness course”), is strictly voluntary.

GuruToYou, LLC, its owners, officers, operators, instructors and consultants/contractors cannot and do not accept responsibility for any injuries, accidents, illnesses, diseases or damage incurred as a result of following the exercises and instructions in its fitness course(s), including therapeutic methods described or mentioned during fitness course(s).

ACKNOWLEDGEMENT

I am aware that participation in fitness courses may be hazardous to my health, and to the health of my unborn child. I also acknowledge that a certain minimum level of physical health, strength, fitness, and flexibility will be required in order to participate in fitness courses. In any physical activity, risk of serious physical injury is possible; fitness classes are no substitute for medical diagnosis and treatment; fitness classes and/or specific exercises are not recommended for individuals with certain conditions (e.g., cardiac illness, pregnancy, high blood pressure, post-surgery, and many more.), thus I have sought medial advice about whether to participate in these fitness classes.

ASSUMPTION OF RISK

I, the undersigned, represent that I possess the level of health, strength, fitness, and flexibility necessary to participate in these fitness course(s). I am voluntarily participating in these fitness courses with knowledge of the risks of potential injury. Therefore, I assume all responsibility and liability for any and all injuries I may sustain due to my participation in these fitness course(s).

Furthermore, I, the undersigned, assumes all responsibility and all risk of damage, accident or injury that may occur to the undersigned or his or her unborn children as a student of any GuruToYou, LLC course, while attending fitness courses, participating in exercises or using fitness advice, props, equipment or facilities or following fitness course instructions in or out of a fitness course location.

LIABILITY RELEASE

In consideration of being accepted as a participant in fitness course(s), the undersigned releases and discharges GuruToYou, LLC and all its associated officers, studios, owners, employees, instructors, contractors, hosts, agents and participants from any and all claims, demands, rights of causes of actions, present, or future, whether known, anticipated or unanticipated, and resulting from, or arising out of, or incident to, the undersigned’s participation or use (or intended use) of a fitness course or location, or facilities and equipment in such place or as a result of, or incident to, engaging in fitness course exercises or otherwise following fitness course instructions, during or after a fitness course, anywhere.

The release shall be binding upon the distributees, heirs, next of kin, administrators and personal representatives of each of the undersigned.

Further, in consideration for being permitted to participate in fitness course(s), I agree that I, my heirs, assignees, guardians, unborn children and/or legal representatives will not make any claim against, sue or attack the property of GuruToYou, LLC or any of its associated officers, studios, owners, employees, instructors, contractors, hosts, agents or participants in any fitness course(s) associated with but not limited to GuruToYou, LLC for injury or damage resulting for my participation.

I further release all such associated officers, studios, owners, employees, instructors, contractors, hosts, agents and participants, heirs and assigns from any and all actions, causes of action, lawsuits, claims, or demands that I, my assignees, heirs, guardians, unborn children, and/or legal representatives now have or hereafter may have for any and all injuries, illness, or loss of damage to property associated with my participation in any fitness course with GuruToYou, LLC.

I do hereby give GuruToYou and its owners, agents, assigns, licensees and legal representatives the irrevocable right to use my commentary, picture, portrait image or photograph in connection with fitness course(s) in all forms of media and in all manners, including electronic media and/or composite representations, for advertising, trade, or any lawful purposes and waives any copyright, trademark and right to inspect or approve the finished product, including written copy, that may be created in connection therewith.

I have carefully read this agreement and fully understand its contents.
